Course Description

This course examines the process of risk management in the multifaceted e-business context. Operational, financial, legal, strategic, and technical aspects of risk management are analyzed. Students will be exposed to emerging and global issues in e-commerce risk management. Each student will prepare a risk management assessment of an existing e-business.

Topics and Objectives

Foundations of e-Law and Risk Management

  • Define risk in the context of e-business.
  • Determine why risk management assessment is essential in e-business.
  • Evaluate a risk management assessment framework.
  • Determine the unique jurisdictional issues in an e-business environment.

Strategic Risk Management

  • Analyze the unique contractual issues associated with an e-business.
  • Analyze the unique taxation issues associated with an e-business.
  • Assess strategic business risks - e.g., matching technological opportunities to your firm's competitive position.
  • Apply a risk assessment framework to analyze technological risk mitigation strategies.

System Security and Tort Issues

  • Identify and distinguish between common law torts for invasion of privacy and major federal laws that regulate privacy in cyberspace.
  • Analyze the continuing tension between various government attempts to regulate content on the Internet and freedom of speech.
  • Apply risk management strategies to ensure that an e-business site does not violate privacy, defamation, and obscenity guidelines.
  • Analyze the legal, financial, and operational consequences of technological deficiencies.

Business Transaction Process Security Issues

  • Evaluate applications of confidentiality, authenticity, and integrity to Internet communications and information security.
  • Analyze the types and risks of computer crimes and the related strategies for safeguarding an e-business.
  • Evaluate the importance of Internet security standards when integrating e-commerce systems.
  • Critique current security protocols used for e-business transactions (e.g.,

Intellectual Property and Jurisdictional Issues in the e-Business Environment

  • Distinguish between the forms of Intellectual Property pertinent to e-business.
  • Analyze the use and misuse of Intellectual Property in an e-business environment.
  • Determine the potential jurisdictional issues and risk management considerations in an e-business transaction.

Emerging Issues in e-Business Risk Management

  • Appraise the various Internet standards applicable to an e-business.
  • Assess global e-business implications of the international marketspace.
  • Prepare a comprehensive e-business Risk Management Assessment.
  • Determine the ethical implications of e-business decision making.
  • Evaluate the regulatory issues in interstate and international e-business.
